Terms of Service

1. Acceptance of Terms

By accessing or using Klickback (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users, including account holders and reviewers who leave feedback via shared links.

2. Description of Service

Klickback is a website feedback tool that allows users to create shareable preview links of websites and collect visual feedback from clients and stakeholders. The Service includes the web application, preview proxy, feedback widget, and related APIs.

3. Accounts

You must create an account to use the Service as a project owner. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload or proxy content that infringes on intellectual property rights
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to distribute malware or phishing content
• Abuse the feedback system with spam or automated submissions
• Resell or redistribute the Service without written permission

5. Content and Ownership

You retain all rights to the content you upload or proxy through the Service. By using the Service, you grant us a limited license to process, store, and display your content as necessary to provide the Service. We do not claim ownership of your content.

6. Payment and Billing

Paid plans are billed monthly via Stripe. Prices are listed in euros and are exclusive of applicable taxes. You can cancel your subscription at any time from your dashboard. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months.

7. Free Plan Limitations

The Free plan is limited to 1 project and 10 feedback items. Preview links on the Free plan expire after 14 days. We reserve the right to modify free plan limitations at any time with reasonable notice.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We are not liable for any downtime or data loss.

9. Limitation of Liability

To the maximum extent permitted by law, Klickback shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time from your dashboard. Upon termination, your data will be deleted within 30 days, except as required by law.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
